GOA v. Memphis lawsuit was filed after Memphis passed Ordinance No. 5908 in 2023, which not only allowed police to seize firearms without a warrant or prior notice based on vague “risk” claims, but also required a local permit to exercise Tennessee’s permitless carry law, banned the sale and transfer of “assault weapons,” and imposed other local gun control. We argued these provisions violated Tennessee’s statewide preemption of firearm regulation, infringed due process, and undermined the uniform laws set by the state legislature, seeking to stop the city from enforcing its own gun-restriction scheme.
